Bloody hell man, that's quite some reading. I wish you all the best in trying to get the money out of him. Even with a court rulling it can be highly problematic for you to get anywhere. I just not long ago won a case against an uninsured driver who crashed into me. Doubt I will get anywhere though. Again, all the best with it!

Good luck to you as well mate, hate uninsured drivers with a passion!

Went to court today because Sycamore Vehicles attempted to 'set aside' the judgement. The judge ripped him a new one, and ruled in favor of us again. We've now appointed 'High Court Sheriffs' (lol) that apparently have more power than normal bailiffs or something. It basically cost him £100 quid to have the piss ripped out of him and thrown out of court, it was the greatest thing that I've ever seen. Merry christmas Mr David Meale of Sycamore Vehicles, 56 High Street, Royston, Barnsley, South Yorkshire.

As Meladygrey said High Court Marshalls have more powers than a standard bailiff. He'll have so long to pay up before they turn up and start seizing goods to settle any debts or fines.

Had another letter through last week saying Sycamore Vehicles had paid £80 to set aside the judgement (again), on the grounds that he believes we have sold the car and are chasing him for two much money. Firstly we aren't claiming for too much, everything is receipted up and accounted for, the bulk of the cost are bailiffs and court fees nothing to do with us. And we haven't sold it, its been stored at a family members house for 7 months. Sycamore Vehicles should count them selves lucky we haven't had to pay for storage or charging interest on the amount owed.

A second letter came two days later, "Upon reading an application from the Defendant and upon the defendant haveing made a pervious application which was refused as a hopeless case it it ordered that the application is refused and the execution is not stayed". So its cost him £80 to be told that he's a hopeless case lol.

This makes great reading. I love it when they get what's coming to them. It's just crazy when you have to jump through hoops to get what you are clearly entitled to.

I had to pay £300 euros to move us out of our holiday apartment last year because it was unfit to live in and was told I had to go through the travel company by writing a certain number of letters giving 30 days for each one before going to ABTA. THe travel company, apartment manager and holiday rep have all lied and I am not allowed to sue the travel company because they are covered by ABTA. ABTA have now told me I have to write to the travel company again stating what I have already told them several times before and then it will go to arbitration with the risk of losing with no alternative but to accept their decision.

This is despite having a comprehensive diary of events, photos of the broken furniture, blocked balcony view and the rat that lived in the room. I thought regulators were there to protect the customer? It makes me bloody furious.

@GingerTom I know the feeling, when I was at uni the land lord tried screwing us out of our deposit, when I mentioned the fact that he left us with out heating for two years, in a grade 2 listed building with sash windows (bloody freezing) and had proof he soon paid up. Harder to win against official bodies and big companies like in your case.

A lot of people are out to screw honest people over because a lot of people, my self included before this, believe you can't do anything about it, people still have the mentality of 'buyer beware' and 'sold as seen' etc. But the fact is that you can do something, it takes a lot of effort and is stressful but worth it when you win. In fact I would say to kids "Don't do drugs, do court cases" because the buzz of winning after all the effort is unmatchable.

I hope that if someone who is in trouble like I was, stumbles across this thread and it helps them out like the help and support I have got from loads of members on this forum.

With regards to a car I don't have a new ST (yet), I'm running a Mazda MX3 1.8 V6 24V DOHC. Its the ABS model, only 313 left and sounds so good!
