So tell me GT what do you pay your premium for?
The way i understood is that they are there to assist you in the event of an accident, fault or non-fault etc etc blah blah blah lol
You pay your premium to repair your car, pay out market value if it's written off and defend you against claims made against you by other parties and pay other parties if you are at fault.
They are not solicitors and it's not their job to claim back your uninsured losses. This is where the legal protection cover comes in. Their legal team will claim back your losses from the other party. Some insurers have this built into their policies and with others you have to pay extra.
People often think just handing it over to the insurer will sort it all out but they will only do what they are paid to do and won't go spending lots of time and money chasing your losses ... only their own.
This is why it's important to have legal protection cover to pursue your losses in the event of a non-fault claim

My Sister is an insurance claims handler for Aviva, those are the basic rules they apply first of all, sorry mate but yes it is as simple as that!
You said "If she hit him her fault, if he hit her then his fault, thats it broken down to it's bare bones"
Well all I can say is if I had her defending me in an accident with that attitude I would not be a happy chap.
If you were driving along and had a car pulled out in front of you and you hit it broadside using that arguement you would be at fault. Does that sound right to you?
The very reason we have claims management companies, solicitors etc is because fighting claims is a huge business. If it was as simple as your statement it would make for a very simple system but with a lot of angry people around.
No 2 accidents are ever the same and all factors have to be taken into account. Just applying a broad sweeping statement of who hit who equals blame is not the way to approach it.
